Terms of Service

These Terms of Service set out the rules for the provision of electronic services and the conditions for concluding and performing contracts for balcony floor installation services by BalkonSetup.

I. General information

The Service Provider is Damian Staciwa operating as "Damian Staciwa", based in Kraków (31-541), al. Powstania Warszawskiego 15, Poland, registered in CEiDG, NIP (Tax ID): 9452240782, REGON: 387783290.

These Terms apply to services provided through the balkonsetup.pl website, including the presentation of offers, scheduling measurements, concluding contracts for balcony floor installation, and processing payments.

To use the website, you need a device with internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active email address.

III. Scope of services

The Service Provider offers balcony floor installation services, including: free balcony measurement, service quotation, computer-aided panel processing (CAD/CNC), and floor installation on the Client's balcony. Information displayed on the website constitutes an invitation to negotiate under the Polish Civil Code.

IV. Ordering a service

The service is ordered by scheduling a free measurement via the website, phone, or email. After the measurement and joint balcony configuration, the Client receives a quotation along with a draft contract by email. The contract enters into force upon the Client's deposit payment. Once the deposit is confirmed, the Client receives access to the installation calendar, where they can independently select the installation date. Detailed terms of service delivery, including the deposit amount and any applicable discount, are specified in the individual contract.

V. Payments

Service prices are quoted in Polish zloty (PLN) and include VAT. The final price is determined individually based on the measurement performed. Payment for the service is made in two parts: (1) deposit - paid upon acceptance of the quotation, the amount of which is agreed individually with the Client and may determine the applicable discount; (2) remaining balance - payable upon completion of the installation service. Available payment methods: bank transfer to the Service Provider's account, online payment via Przelewy24, cash. The online payment operator is PayPro SA, based in Poznań (60-198), ul. Pastelowa 8, registered in the National Court Register (KRS) under number 0000347935, NIP: 7792369887, REGON: 301345863, entered in the register of national payment institutions maintained by the Polish Financial Supervision Authority (KNF) under entity number IP24/2014. Available online payment methods include: BLIK, payment cards (Visa, Mastercard), fast bank transfers, and other methods provided by Przelewy24. Online payments are processed immediately after the Client submits the payment instruction in the Przelewy24 system.

VI. Payment refunds

In the event of contract withdrawal or a justified complaint, the Service Provider shall refund the payment to the bank account from which the payment was made, or - in the case of card payments - to the card used for the transaction. The refund shall be made within 14 days from the date of accepting the complaint or receiving the withdrawal statement. The deposit paid is subject to refund in accordance with the Polish Civil Code (Art. 394) and the individual contract concluded with the Client. For payments made via Przelewy24, the refund is processed through the same payment channel.

VII. Complaints

Complaints regarding the performed service can be submitted by email to kontakt@balkonsetup.pl. The complaint should include: a description of the issue, the Client's contact details, the service completion date, and the expected resolution. The Service Provider will respond within 14 calendar days of receipt.

VIII. Right of withdrawal

A Client who is a consumer has the right to withdraw from a distance contract within 14 days without giving any reason. The withdrawal statement may be submitted by email to kontakt@balkonsetup.pl. In the event of withdrawal, the Service Provider shall refund all payments received, including the deposit, within 14 days from the date of receiving the withdrawal statement, using the same payment method used by the Client. The right of withdrawal does not apply if the Service Provider has fully performed the service with the express consent of the Client, who was informed before the commencement of the service that they would lose the right of withdrawal upon completion (Art. 38(1) of the Polish Consumer Rights Act of 30 May 2014).

IX. Final provisions

The service agreement is concluded in Polish. Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code, the Act on Provision of Electronic Services, and the Consumer Rights Act. The Service Provider reserves the right to amend these Terms for important legal or technical reasons. Disputes are resolved by the competent courts.

X. Alternative dispute resolution

A Client who is a consumer may use out-of-court complaint and redress mechanisms, including: mediation through provincial trade inspectorates, assistance of municipal or district consumer ombudsmen, and the EU Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr.
